Scaffold Accident Laws Still Protects
Workers
Since 1800s, New York State sought to provided protection
for construction workers who have been hurt on ladders and scaffolding. The laws
involving scaffold protection offers workers on New York construction sites the
chance to sue contractors and property owners directly for liability when an
accident and injury has taken place on the construction site. This could
include compensation for not only the cost of medical treatment and loss of
wages, but punitive damages and pain and suffering as well.
For a more than a hundred years the New York City skyline
has been filled with world-class skyscrapers. The efforts to make this the Empire State would not be
possible without the hard work of our construction workers operating on
scaffolding. This dangerous work
is highly regulated and provides scaffold workers with safety standards. When these standards are breached,
those responsible can be held accountable for their injuries.
New Legislation Proposed
Recently new legislation has been proposed to change the
scaffold accident law so as to favor the property owners and contractors. Up to
now, if a construction worker is injured while using a ladder or scaffolding,
then the contractor, in order to eliminate fault, would have to prove that the
job site was actually safe.
The interest in changing the current scaffold accident law
is to try to lower liability insurance costs for contractors / property owners
and is also an attempt to reduce compensation payments to injured scaffold and
ladder workers paid out by the insurance companies. Basically it is an attempt
to reduce workers opportunities for claiming compensation payments when in many
cases the accident and resultant injury were not his or her fault.
Construction site workplaces can be dangerous places and for
the time being scaffold and ladder workers are entitled to determine if they
are eligible to file a claim for compensation if injured while in the course of
their duties.
If you or a member of your family has been injured in a scaffold
accident on a construction site, you should contact our experienced personal
injury lawyer to assess your eligibility to file a compensation claim while the
law is still in your favor. A statute of limitation applies in New York and you
have three years from the date of your injury to make a claim.
