Police Officer Injuries – They Have a Right to Sue
New York law affords injured police officers a legal remedy
for work related injuries under the premise that a person who has violated a law
which has either directly or indirectly brought about the injury may be sued in
a civil action. If you are an
injured police officer, give our lawyers a call at 800-893-9645 to set up your
confidential consultation.
Every police officer may have this remedy. This includes NYPD, Nassau County PD,
Suffolk County PD, Yonkers Police, and more.
The General Municipal
Law
General Municipal Law 205 permits every police officer in
the State of New York who is killed or injured in an accident to sue any person
who violated the requirements of any statutes, rules, ordinances, orders and
requirements of the state, county, village, town, city or federal governments.
These incidences occur in a broad range of situations which
include motor vehicle accidents, premises liability and any injuries which may
take place due to assaults, dispersal of fights and gun sales that are illegal.
Police officers commonly are required to investigate all types of criminal
activity or respond to calls from buildings which are not up to standard and which
violate established building codes.
If any dangerous conditions in buildings cause injuries, the
owner or administrator of the building can be sued by the police officer. Also,
certain provisions in the Alcohol Beverage and Control law make it possible to
sue clubs, bars, liquor stores and even hosts of parties who break the ABC Law
and cause injury to a police officer.
Police officers can sue people or companies as a result of
premises liability as well when they are on those people’s premises in the
course of their duty.
A Police Officer Will
