AUO

Driving with a suspended license can be either a misdemeanor or a felony.  The most common charge is written under Vehicle Traffic Law Section 511.1.  

VTL 511.1 AUO in the 3rd Degree is an unclassified misdemeanor and can carry a 30 day jail sentence and hundreds of dollars in fines.  Most importantly, a conviction to this charge can result in a driver having permanent criminal record.  A criminal conviction can adversely affect a driver’s ability to find a job, acceptance into college, or immigration petition.

      
VTL 511.2 AUO in the 2nd Degree is a higher level misdemeanor that AUO 3rd. This unclassified misdemeanor is punishable with up to 180 days in jail, a mandatory fine from $500 to $1000 Jail time is minimum mandatory 7 days or 3 years probation. 

This crime is committed when a driver:
   
1.    Operates their care with an alcohol related suspension or revocation;
2.    Operates their car with 3 or more active suspensions or revocations that
have occurred on 3 or more separate dates;
3.    Commits the crime of AUO in 3rd Degree and have been convicted of the same within the previous 18 months.

VTL 511.3 AUO in the 1st Degree.  This is a felony charge punishable with up to 4 years in state prison.  There is a mandatory fine of $1,000 to $5,000. This offense is committed when a driver:
  
1.    Operates a motor vehicle and has 10 or more suspensions or revocations imposed on 10 different dates or

2.    Commits the offense of AUO - 2nd Degree while intoxicated or impaired by alcohol or drugs.



About Tuckahoe Village Court

Tuckahoe Village Court is located at 65 Main Street, 2nd Floor, in Tuckahoe.  The court does not have a dedicated parking lot for visitors.  However, there is ample metered parking on the street for visitors.  The court is accessible by public transportation.  The Metro North train is one block away from the court.  

The court is handicapped accessible and is adjacent to the Village Police Department.  There is an elevator for visitors located to the side of the stairwell near the restrooms on the first floor.

The court has limited jurisdiction over criminal and civil cases.  The court can adjudicate all misdemeanor matters such a criminal possession of a controlled substance in the 7th degree and assault in the 3rd degree, all traffic cases such as speeding and cell texting while driving, and limited felony matters.  With respect to civil cases, the court routinely presides over landlord tenant matters, zoning violations, and small claims violations.

While the court clerk’s office is open from Monday through Friday, Court is only held on Tuesdays.  Court is held in the mornings except for one night court session held per month.
